Public-Private Partnership (PPP) Model

Governed by the Law of Ukraine «On Public-Private Partnership» (No. 4510-IX), which, with the exception of certain provisions, entered into force on October 31, 2025. While this model is the most complex, it also offers the highest level of protection for infrastructure investors, as the new law has been specifically adapted for post-war infrastructure reconstruction and aligned with EU legislation. At the same time, the full implementation of the updated PPP framework requires the adoption of a number of additional by-laws, which are currently being drafted.

Legal & technical parameters

Key changes in the PPP Law

For the period of martial law and for seven years following its termination or cancellation, a simplified procedure applies to the preparation of state and local PPP projects aimed at restoration in the areas of healthcare, energy, social and transport infrastructure.

Detailed conditions of the model

  • Supervision methods

Control and monitoring of KPI (Key Performance Indicators).

  • Insurance models

A PPP agreement and a concession agreement may contain a condition on insurance of the object.

  • Distribution of ownership rights

As a general rule, property becomes the property of the public partner.

  • Risks and their mitigation

Demand risk, corruption risks, legislative instability risk.

International Model (Ukraine Facility)

Used in large infrastructure projects under the auspices of the EU and international financial organizations (IFOs).

Legal & technical parameters

Detailed conditions of the model

  • Supervision methods

Governing Board, Government of Ukraine, indirect management.

  • Insurance models

    Ukrainian guarantee, war-risk insurance.

Default risk, collateral shortage, non-compliance with reforms.

Significant Investment Model

Applicable to industrial reconstruction in accordance with Law No. 1116-IX «On State Support for Investment Projects with Significant Investments in Ukraine» dated December 17, 2020.

Legal & technical parameters

Detailed conditions of the model

  • Supervision methods

State «investment nanny» — the UkraineInvest Office accompanies the project. Financial control is ensured through tax monitoring.

  • Insurance models

Insurance of capital investments against military risks through the ECA (Export Credit Agency of Ukraine).

  • Distribution of ownership rights

100% private ownership of assets. Land plots are leased or used for the duration of the SIA (Article 9 of the Law).

  • Risks and their mitigation

Risk of nationalization or unlawful interference, risk of unstable business conditions.

State-Run Digital Model (DREAM Ecosystem)

This model is the standard for the restoration of public infrastructure using budget funds. Users of the DREAM system’s public portal can be international financial organizations and investors, business representatives, journalists, and public activists.

Legal & technical parameters

Detailed conditions of the model

  • Supervision methods

Digital Restoration Ecosystem for Accountable Management, use of USESFC, monitoring of public procurement.

  • Insurance models

The least protected model; the risks of repeated destruction fall on the budget (restoration at the expense of reserve funds).

  • Distribution of ownership rights

Municipal or state property — the state/community retains ownership of assets (buildings, infrastructure) financed from the budget.

  • Risks and their mitigation

Corruption risks, insufficient capacity of local authorities, lack of statutory regulation, low civil-society participation.
